Sefa seizes aerial platform, soybeans, and wooden portals

Irregularities found were the so-called "traffic break", non-collection of ICMS, and lower collection of the due tax

During an inspection carried out on Tuesday (23) by state revenue inspectors from the State Department of Finance (Sefa), an articulated aerial platform valued at R$ 900,000.00 was seized. The officials are assigned to the Coordination of Control of Goods in Transit of Carajás, in the southeast of the State.

“In an approach at the Carajás Railway tax post in Marabá, a truck transporting goods from the municipality of Parauapebas/PA, with a declared destination, in the invoice, to Capão Bonito/SP was stopped. The inspection team suspected the truck's route and after analyzing documents and in the system, it was found that the actual destination of the goods was the State of Tocantins, a fact confirmed by a correction letter issued only after the start of the inspection,” explained the coordinator, Cicinato Oliveira.

Due to the discrepancy between the declared destination in the tax document and the actual destination of the goods, the operation was characterized as irregular and considered a traffic break, when the invoice informs one destination for the goods and they are delivered to another location. A Seizure and Deposit Term (TAD) was drawn up in the amount of R$ 15,390.00.

Soybeans - On the same day, state revenue inspectors from the Coordination of Control of Goods in Transit of Araguaia, from Sefa, seized 78,600 kg of soybeans at the Barreira do Campo tax post, on the PA-441 highway km 38, Santana do Araguaia, which left Santana do Araguaia-PA destined for Orlândia-SP. The cargo is valued at R$157,200.00.

“When verifying the documents, we saw that there was no collection of the advance ICMS of the goods upon leaving the State, nor the collection of the ICMS on freight,” said the coordinator, Renato Couto.

Four Seizure and Deposit Terms (TADs) were drawn up in the total amount of R$30,231.60, which were collected and the goods released.

Wooden portals - Also on Tuesday (23), at the Coordination of Control of Goods in Transit of Gurupi, in Cachoeira do Piriá, 40 cubic meters of wooden portals were seized, which left Moju-PA destined for Barra da Estiva-BA.

"When analyzing the value of the goods, a considerable difference in value was found compared to the Minimum Price Bulletin, which lowered the tax calculation base, consequently leading the taxpayer to a lower collection of the due tax. In addition, it was verified that the cargo belonged to a third party, and that there was no collection of the ICMS on freight, as required by law,” informed the coordinator, Gustavo Bozola.

The value of the cargo and the freight service was arbitrated according to the Minimum Price Bulletin at R$ 95,106.15, and two Seizure and Deposit Terms (TADs) were drawn up in the total amount of R$ 19,920.56, referring to the tax and fine.
