PGE expands its conciliation services in Detran demands and receives cases of non-communication of vehicle sales

Communication of the sale of a vehicle to the State Department of Transit (Detran) is a mandatory and relatively simple procedure

The State Attorney General's Office will also act to resolve cases of mandatory non-communication of vehicle sales

Starting next Monday (25), the State Attorney General's Office (PGE) will expand its conciliation services in demands from the Department of Transit of Pará (Detran-PA) and will also start receiving, through its Chamber of Negotiation, Conciliation, Mediation, and Arbitration (PCAM), cases related to the absence of communication of vehicle sales.

“We are talking about situations where the citizen sells a vehicle, but there is no formal communication to Detran to initiate the procedure for transferring ownership to the buyer. This is a mandatory procedure, essential to prevent the responsibility for fines and taxes from falling on someone who no longer possesses the vehicle, since, according to Article 134 of the CTB, the former owner is jointly liable for debts until the date of communication of the sale,” explained Marcela Braga Reis, Chief Attorney of the Controversies of Autarchies and Foundations Attorney's Office (PCAF).

Since November 2024, PCAM has expanded its services and has started to mediate demands involving Detran. Among them, in addition to the non-communication of vehicle sales, are cases of improper vehicle transfers and those related to delays in the issuance and renewal of the National Driver's License (CNH). This innovation has been ensuring the resolution of conflicts more quickly and without the need for litigation.

“For PGE, it means acting in a more strategic and preventive manner, reducing the number of lawsuits and making the operation more efficient. For society, it means resolving situations more swiftly, without the need for lengthy legal disputes, ensuring savings in time and resources,” added Marcela.

According to the chief attorney, citizens can approach the PGE Conciliation Chamber as soon as they identify that the buyer has not completed the transfer of the vehicle to their name. There is no deadline for attempting conciliation. When approaching PCAM, the citizen will be informed of the possibilities for resolving their situation.

“The proposal is that this be yet another topic available for resolution through agreement. Gradually, new relevant issues for society may be included, always with the aim of reducing judicial conflicts and providing quicker responses to citizens,” she concluded.

How it works - Interested parties should send the request by email ([email protected]), requesting the agreement request form. The document will also be available directly on the institution's website. After filling it out, the interested party must send the form with copies of the requested identification documents to the same email. The PCAM team will analyze the situation with Detran and respond to the interested party regarding the possibility of an agreement. People with ongoing legal actions can also approach the Conciliation Chamber.
